Modificarea Codurilor penale a fost aprobată, miercuri, în Camera Deputaților – for decizional -, cu ajutorul voturilor UDMR, Minorităților și a unui vot de la PMP (Corneliu Bichineț).
Concret, au fost 180 de voturi “pentru” în cazul Codului penal, în condițiile în care PSD+ALDE au numai 158 de deputați, iar necesarul de voturi era de 165.
Au votat împotrivă 83 de deputați, iar unul s-a abținut.
În cazul Codului de procedură penală au fost 180 de voturi ”pentru”, 81 ”împotrivă” și 2 abțineri.
La Codul de procedură penală au votat ”pentru”, pe lângă deputații PSD și ALDE, și 13 deputați UDMR, 8 deputați de la minorități, 3 deputați neafiliați și unul de la PMP.
La Codul penal au votat ”pentru”, pe lângă deputații PSD și ALDE, și 13 deputați UDMR, 7 deputați de la minorități, 3 neafiliați și unul de la PMP.
Florin iordache a declarat, după vot: “A fost adoptat, ce mai vreți?”.
Cele două legi vor merge la promulgare la președintele Klaus Iohannis.
Opoziția va ataca la CCR
Până atunci însă, USR și PNL au anunța că vor atacat la Curtea Constituțională aceste acte normative.
Liderul deputaţilor PNL, Raluca Turcan, a declarat, în plenul Camerei:
“Transmiteţi un mesaj usturător Comisiei de la Veneţia că nu vă pasă şi sunteţi singuri în ţară şi faceţi ce doriţi. Fac un apel şi de suflet, de mamă a unui copil de 11 ani, a oamenilor cinstiţi, nu vă daţi votul pentru o lege care favorizează corupţii în acte publice, descurajează orice om cinstit din ţară. Prin aceste modificări spuneţi că legea este auxiliară. PNL nu poate şi nu va vota aceste modificări. Dacă veţi obţineţi voturile necesare pentru adoptare, (…) vom contesta la CCR această nenorocită de lege care va arunca România la periferia Europei. (…) Sper că UDMR, minorităţi să nu voteze, sper că cei din ALDE nu vor vota”.
Modificările criticate prevăd:
- Reducerea cu 2 ani a termenelor de prescripţie a pedepselor – prevedere menită să îl scape de pușcărie pe Liviu dragnea, condamnat la 3 ani și 6 luni de închisoare cu executare, în primă instanță. Termenele de prescripţie a răspunderii penale vor fi: de 8 ani faţă de 10 ani în legea în vigoare, când legea prevede pentru infracţiunea săvârşită pedeapsa închisorii mai mare de 10 ani, dar care nu depăşeşte 20 de ani; şi de 6 ani în loc de 8 ani când legea prevede pentru infracţiunea săvârşită pedeapsa închisorii mai mare de 5 ani, dar care nu depăşeşte 10 ani.
- Abrogarea articolului referitor la infracțiunea de neglijenţă în serviciu.
- Introducerea unui termen de un an în care se poate face un denunţ: “Mituitorul nu se pedepseşte dacă denunţă fapta mai înainte ca organul de urmărire penală să fi fost sesizat cu privire la aceasta, dar nu mai târziu de un an de la data săvârşirii acesteia”.
- Interzicerea, în cursul urmăririi penale şi al judecării cauzei, a comunicărilor publice şi a declaraţiilor publice, precum şi furnizarea altor informaţii, direct sau indirect, provenind de la autorităţi publice referitoare la faptele şi persoanele ce fac obiectul acestor proceduri. Persoanele din cadrul autorităţilor publice nu se pot referi la persoanele suspectate sau inculpate ca şi cum acestea ar fi vinovate, decât în cazul în care există o hotărâre definitivă de condamnare cu privire la acele fapte.
