Inspecția Judiciară (IJ) începe miercuri controlul la DNA pe tema celor 300 de dosare deschise unor judecători și procurori.
Anunțul IS a fost făcut printr-un comunicat postat pe Facebook, luni seară:
“Inspecţia Judiciară, prin inspectorii de la Direcţiile de inspecţie judiciară pentru procurori şi, respectiv, judecători, va efectua în perioada 1 august – 1 octombrie 2018 un control tematic comun privind respectarea principiilor generale care guvernează activitatea Autorităţii Judecătoreşti în cauzele de competenţa Direcţiei Naţionale Anticorupţie vizând magistraţi sau în legătură cu acestea”.
Verificările vizează perioada 1 ianuarie 2014 – 30 iulie 2018, iar raportul va fi înaintat Consiliului Superior al Magistraturii până la 5 noiembrie 2018.
Luni dimineață, ministru Toader a declarat că “nu am știut nici unul dintre noi” despre existența acestor dosare. El nu a precizeat însă cine sunt ceilalți în afară de el care trebuiau să fi știut.
„Nu am ce să comentez decât că am aflat şi eu că sunt 300, dar cred că a spus 300 de dosare care trebuiesc transferate şi într-o cauză pot fi mai mulţi făptuitori autori suspecţi ce or fi dânşii. La momentul la care va avea loc transferul sigur o să vedem la ce se referă respectivele cauze. Evident că şi mie mi se par foarte multe, evident că nu am ştiut nici unul dintre noi aşa ceva şi tot evident cred este şi faptul că aşa se poate justifica împotrivirea ca respectiva secţie să se înfiinţeze la Ministerul Public”, este declarația completă a ministrului Justiţiei, Tudorel Toader.
În urmă cu o săptămână, președintele Klaus Iohannis a anunțat că este “obligat” să promulge actul normativ adoptat de majoritatea parlamentară PSD+ALDE+UDMR privind modificarea și completarea Legii 304/2004 privind organizarea judiciară.
Noua lege prevede, printre altele, înfiinţarea Secţiei speciale pentru investigarea infracţiunilor din Justiţie – adică o structură care se va ocupa strict de anchetarea judecătorilor și procurorilor.
Toate dosarele în care sunt anchetați procurori și judecători vor trebui transferate de DNA la noua Secție, care va funcționa în cadrul Parchetului General.
Iar cum graba este imensă din partea magistraților cu probleme de corupție care populează instanțele, Inspecția Judiciară ar putea sigila cele 300 de dosare aflate în lucru acum la DNA.
Aceasta, mai ales că Raluca Prună, fost ministru al Justiției în Guvernul Cioloș, a declarat că noua Lege 304 nu poate intra în vigoare așa curând, deoarece trebuie urmată de o legislație secundară, care încă nu a fost adoptată.
În planul său de management depus pentru ocuparea funcției de procuror-șef al DNA, Marius Iacob, fost adjunct al Laurei Codruța Kovesi, a precizat că 300 de magistrați au dosare de corupție:
“Înfiinţarea Secţiei pentru investigarea infracţiunilor din Justiţie în cadrul Parchetului de pe lângă Înalta Curte de Casaţie şi Justiţie duce la modificarea competenţei DNA cu privire la persoanele care deţin calitatea de judecător sau procuror. Legea nr. 207/2018 prevede şi obligaţia Direcţiei Naţionale Anticorupţie de a înainta cauzele în care sunt cercetaţi magistraţi, la momentul în care secţia devine operaţională. În prezent, la Direcţia Naţională Anticorupţie sunt înregistrate aproximativ 300 de cauze care se află în această situaţie”.
Numai că atât Iacob, cât și ceilalți 3 candidați au fost respinși de ministrul Tudorel Toader, care a lansat o nouă procedură de desemnare a șefului DNA.
