Parlamentarii PNL și USR au atacat marți la Curtea Constituțională a României (CCR) Ordonanța de urgență nr 90/2018 privind operaţionalizarea Secţiei speciale pentru investigarea infracţiunilor din Justiţie.
Totodată, cei din opoziție au solicitat CCR să sesizeze și Curtea de Justiție a Uniunii Europene (CJUE) cu privire la obligativitatea respectării rapoartelor MCV.
Secția specială pentru investigarea infracțiunilor comise de judecători și procurori – inclusiv plângerile penale depuse împotriva lor în majoritate de infractori – a devenit operațională în cadrul Parchetului General în ata de 23 octombrie.
De la acea dată, toate dosarele având acest obiect și aflate în lucru la Direcția Națională Anticorupție și la alte unități de parchet, precum și dosarele soluționate până la această dată au fost preluate de noua structură.
Secția a fost înființată prin modificarea uneia dintre cele 3 Legi ale Justiției – Legii privind organizarea judiciară, intens contestată de sistemul judiciar, dar și de Comisia Europeană, care a cerut în cadrul raportului MCV suspendarea aplicării celor 3 legi.
OUG 90 a fost adoptată la insistențele ministrului Justiției, Tudorel Toader, la puțin timp după ce a declanșat procedurile de revocare a procurorului general al româniei, Augustin Lazăr.
Totodată, Adina Florea, propusă de ministrul Justiției pentru șefia DNA și respinsă de președintele Klaus Iohannis, a fost numită procuror-adjunct al secției.
