Camera Deputaților – for decizional – a adoptat miercuri, cu 165 voturi „pentru”, 90 de voturi „împotrivă” și 3 abțineri, inițiativa legislativă a liderului PSD, Liviu Dragnea, privind repatrierea, de către BNR, a 91,5% din aurul depozitat de România în străinătate.
În acest sens, a fost modificat şi completat art.30 din Legea nr. 312/2004 privind Statutul Băncii Naţionale a României (BNR).
Totodată, a fost introdusă și obligativitatea ca, în caz de situaţie de criză care ar pune în pericol stabilitatea monetară, ţinta de inflaţie sau politicile macroeconomice, BNR să informeze Parlamentul şi Guvernul în cel mult 20 de zile.
„(1) Banca Naţională a României, respectând regulile generale privind lichiditatea şi riscul specific activelor externe, stabileşte şi menţine rezerve internaţionale, în astfel de condiţii încât să poată determina periodic mărimea lor exactă, rezerve alcătuite cumulativ ori selectiv din următoarele elemente:
a) aur deţinut în tezaur în ţară sau depozitat în străinătate;
b) active externe, sub formă de bancnote şi monede sau disponibil în conturi la bănci sau la alte instituţii financiare în străinătate, exprimate în acele monede şi deţinute în acele ţări, pe care le stabileşte Banca Naţională a României;
c) orice alte active de rezervă, recunoscute pe plan internaţional, inclusiv dreptul de a efectual cumpărături de la Fondul Monetar Internaţional în cadrul tranşei de rezervă, precum şi deţinerile de drepturi speciale de tragere;
d) cambii (act prin care cel care semnează se obligă să plătească, necondiţionat, la un anumit termen şi într-un anume loc, o sumă de bani.), cecuri, bilete de ordin, precum şi obligaţiuni şi alte valori mobiliare, negociabile sau nu, emise sau garantate de persoane juridice nerezidente, clasificate în primele categorii de către agenţiile de apreciere a riscurilor, recunoscute pe plan internaţional, exprimate şi plătibile în valută în locuri acceptabile pentru Banca Naţională a României;
e) bonuri de tezaur, obligaţiuni şi alte titluri de stat, emise sau garantate de guverne străine sau de instituţii financiare interguvernamentale, negociabile sau nu, exprimate şi plătibile în valută în locuri acceptabile pentru Banca Naţională a României.
(2) Banca Naţională a României urmăreşte menţinerea rezervelor internaţionale la un nivel adecvat tranzacţiilor externe ale României”, prevede noua lege.
În prezent, România are rezerve de aur, care fac parte din rezervele internaţionale, de aproape 103,7 tone, respectiv 103.697 de kilograme şi 790 grame de aur fin, reprezentând 9-10% din rezervele internaţionale ale ţării.
Cantitatea de aur din rezervă este aproximativ aceeşai din 2007 până în prezent, dar valoarea ei a crescut de la 1,6 miliarde de euro în 2007 la 3,7 miliarde euro în decembrie 2018. Circa 60%, peste 61,2 tone, este depozitat la Banca Angliei, dar se află în custodia BNR, astfel că Banca Angliei nu poate efectua niciun fel de operaţiuni care vizează aurul României. Faţă de aceste niveluri, reiese că proiectul de act normativ propune ca România să mai păstreze rezerve de aur în străinătate de 5,185 tone, iar repatrierea să fie de peste 56 de tone, respectiv 91,5% din cantitatea actuală aflată în străinătate. Camera Deputaților a avut rol de for decizional în acest caz.
