Reprezentanţi ai Comisiei de la Veneţia s-au întâlnit marți cu președinții celor două Comisii juridice ale Parlamentului României – Șerban Nicolae (PSD), la Senatului, și Eugen Nicolicea (PSD), la Camerei Deputaților -, fără ca restul senatorilor și deputaților să știe acest lucru, a reclamat deputatul USR Stelian Ion, membru al Comisiei Juridice.
„Astăzi am aflat pe căi indirecte despre întâlnirea președintelui Comisiei Juridice, de disciplină și imunități a Camerei Deputaților, dl. Eugen Nicolicea, cu reprezentații Comisiei de la Veneția. La începutul ședinței Comisiei juridice, d-na Alina Elena Tănăsescu ne-a înștiințat că ședința se contramandează întrucât dl. Nicolicea se află la o întâlnire cu reprezentanții Comisiei de la Veneția. La întrebarea pe care i-am adresat-o, doamna Tănăsescu nu a putut explica de ce opoziția nu a fost invitată la această întâlnire”, a declarat Stelian Ion.
“Presupunem că tema discuției este legată de legile justiției. Lipsa de transparență a devenit deja o obișnuință pentru PSD. Reamintesc faptul că nici anul trecut opoziția nu a fost invitată la întâlnirile cu delegațiile din partea Comisiei Europene, noi aflând despre aceste întâlniri din surse neoficiale”, a adăugat el.
Stelian Ion a mai spus că nu ştie dacă reprezentanţii Comisiei de la Veneţia au venit din proprie iniţiativă.
„Nu ştim dacă au venit din proprie iniţiativă sau dacă au fost invitaţi atâta vreme cât nu am ştiut nici măcar că există o asemenea delegaţie astăzi în Parlamentul României. Am presupus că este vorba de legile justiţiei şi probabil de propunerile de modificare a codurilor penal şi de procedură penală. Dacă mai rămân şi dacă vom afla acest lucru cu siguranţă trebuie să luăm şi noi legătura. (…) A fost o discuţie informală, doar am fost anunţaţi că nu se va ţine această Comisie juridică, urmează să facem demersurile în perioada imediat următoare pentru a ne întâlni şi noi cu aceşti reprezentanţi”, a precizat Stelian Ion.
Nicolicea se disculpă: A fost Weiner
Eugen Nicolicea s-a disculpat spunând că USR a participat la întâlnirea cu reprezentanţii Comisiei de la Veneţia, pe tema proiectului de lege privind finanţarea ONG-urilor – depus de Şerban Nicolae şi Liviu Pleşoianu.
„La întâlnirea cu reprezentanţii Comisiei de la Veneţia a participat domnul Weiner, de la Senat. La întâlnire au fost chemaţi preşedinţii de comisii, dacă nu au avut funcţii la comisie, nu au avut pe cine să trimită”, a declarat Nicolicea, pentru Mediafax.
Şerban Nicolae: N-am discutat despre Legile Justiției
Şerban Nicolae a precizat, ulterior, că a discutat cu reprezentanţii Comisiei de la Veneţia numai despre proiectul de lege privind finanţarea ONG-urilor, nu despre legile Justiţiei.
„Nu, pentru că nu se practică, cel puţin la acest nivel, o scamatorie de genul ăsta – venim pentru o temă şi abordăm o altă temă. Nici nu aveau cum pentru că nu puteau fi mandataţi de APCE cu o temă care ţine de legislaţia internă a României”, a spus senatorul PSD.
„Am fost informat în urmă cu mai multe zile de faptul că la Adunarea Parlamenară a Consiliului Europei s-au primit sesizări sau a fost atenţionată în legătură cu proiectul de lege iniţiat de mine şi de Liviu Pleşoianu cu privire la transparentizarea finanţării ONG-urilor şi o reglementare ceva mai clară şi mai predictibilă în privinţa acordării statutului de organizaţie de utilitate publică. APCE a solicitat o informare din partea Comisiei pentru Democraţie prin Drept, cunoscută sub numele generic <<Comisia de la Veneţia>>”, a precizat el.
Şerban Nicolae a arătat că a programat o întâlnire cu acest corp de experţi, din care fac parte şi doi membri ai Comisiei de la Veneţia din Islanda şi din Marea Britanie, iar alături de el participat Liviu Pleşoianu.
Luni, reprezentanţii Comisiei de la Veneţia au avut întâlniri la ministerul Justiţiei şi cu ONG-urile.
„După întâlnirea cu noi a mai fost o întâlnire programată cu preşedintele Comisiei juridice din Camera Deputaţilor, Eugen Nicolicea, cu preşedinţi ai comisiilor pentru Drepturile omului şi egalitatea de şanse tot din Camera Deputaţilor şi cu Titus Corlăţean – senatorul care conduce delegaţia Romaniei la APCE”, a adăugat Şerban Nicolae.
El a mai spus că reprezetanţii Comisiei de la Veneţia au vrut să afle dacă proiectul privind ONG-urile este de natură să aducă atingere vieţii asociative din România, societăţii civile, dacă restricţionează, dacă stabileşte interdicţii, dacă există vreo altă formă de presiune.
„A fost un dialog deschis, a durat mult mai mult decât prognozasem noi (…), cam două ore şi jumătate. Lucrurile sper să fi fost lămurite. În fapt este un lucru destul de simplu – am spus de un an de zile de când am propus această modificare a legii asociaţiilor şi fundaţiilor – Ordonanţa de Guvern 26 pe 2000 – că nu dorim altceva decât ca acest mecanism de acordare a statutului de utilitate publică unor ONG-uri să fie transparent pe criterii clare şi evaluabile periodic iar, în ceea ce priveşte finanţarea ONG-urilor, să existe o transparentizare totală, astfel încât o activitate morală, legală, publică, utilă social, să nu aibă niciun fel de suspiciune cu privire la identitatea finanţatorilor sau a sumelor care le vehiculează”, a spus Şerban Nicolae.
El a arătat că, împreună cu Pleşoianu, a ţinut cont de mai multe observaţii ale ONG-urilor, au formulat amendamente, depuse la Camera Deputaţilor, (proiectul a trecut tacit de Senat, n.r.) care privesc exceptarea de la obligaţia publicării semestriale a listei de finanţări a donatorilor şi a sumelor primite de la diferiţi donatori prin SMS şi exceptarea de la publicare a donaţiilor rezultate prin redirecţionarea a 2 % din impozitul pe profit al persoanelor fizice.
